The rapid development in artificial intelligence has fueled a rise in copyright infringement lawsuits. AI systems often generate content based on copyrighted materials without proper consent. Organizations are "traversing an area where we don't know a lot yet," so they must understand whether these lawsuits are about infringement or lack of due diligence, said Shefali Mookencherry, CISO and chief privacy officer at the University of Illinois at Chicago.

"There are consent issues from a patient privacy perspective, or even copyrighted material, where, if an artist creates their own painting and a prompt is put into an AI system, it generates that artist's authorship or penmanship," she said.
Legal teams are struggling with AI's diverse use cases, said Kenneth Townsend, CISO at Ingredion. Improper data handling could lead to significant legal ramifications, he said, prompting the need for further study before AI can be comfortably integrated into business operations. Especially in nonhealthcare companies where data is often licensed, AI-generated data must be handled cautiously, he said.
"Working with our legal team, it has caused them to scratch their heads a bit," Townsend said. "Every use case is so different, and I think it is an opportunity."
